1. Acceptance of Terms

By accessing or using HealthFlow (“HealthFlow,” “we,” “us,” or “our”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, do not use the service.

When you create an account, you will be asked to affirmatively accept these Terms and our Privacy Policy by checking the required consent boxes. Your acceptance, including the date, time, and version of Terms accepted, is recorded and stored in our systems as part of our compliance and audit trail.

2. Eligibility and Age Requirements

You must be at least 18 years old to create an account and use HealthFlow, unless a parent or legal guardian creates or supervises your use of the service. By using HealthFlow, you represent that you meet this requirement.

3. Privacy and Data Practices

Your use of HealthFlow is also governed by our Privacy Policy, which explains how we collect, use, and protect information. By using HealthFlow, you consent to the data practices described in the Privacy Policy.

4. Strong Medical Disclaimer (No Medical Advice)

HealthFlow provides tools for organizing, viewing, and tracking health-related information for informational and support purposes only. HealthFlow does not provide medical advice, and is not a substitute for professional medical advice, diagnosis, or treatment.

You should always seek the advice of a licensed healthcare provider with any questions regarding a medical condition, symptoms, medications, or treatment decisions. Never disregard professional medical advice or delay seeking it because of something you read or see in HealthFlow.

If you believe you may be experiencing a medical emergency, call 911 (or your local emergency number) immediately.

5. Service Description

HealthFlow may provide features such as:

  • Remote patient monitoring tools
  • Health data tracking and visualization
  • Medication reminders and notifications
  • Educational health resources and content

Features may change over time, and we may add, remove, or modify functionality at our discretion.

6. Device and Data Accuracy

HealthFlow may display information from third-party devices (such as wearables, cuffs, or meters) and from user-entered data. Device readings and home measurements can be inaccurate or incomplete due to hardware limitations, user technique, connectivity, and other factors.

You are responsible for confirming important readings clinically (for example, with a healthcare provider or clinically validated methods) before making health decisions.

7. Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. If you believe your account has been compromised, you must notify us promptly at info@evbohealth.com.

8. User Responsibilities

You agree to:

  • Provide accurate information to the best of your knowledge
  • Use the service in accordance with all applicable laws and regulations
  • Not share your account credentials with others (except a guardian as permitted)
  • Keep your contact information up to date

9. Acceptable Use

You agree not to:

  • Use HealthFlow for unlawful, harmful, or fraudulent purposes
  • Attempt to gain unauthorized access to systems, accounts, or data
  • Scrape, crawl, harvest, or copy content or data without permission
  • Reverse engineer, decompile, or attempt to discover source code or underlying algorithms
  • Interfere with or disrupt the service, servers, or networks
  • Upload malware or engage in activity that could compromise security

10. Third-Party Services

HealthFlow may rely on or integrate with third-party services and providers (for example: hosting and databases such as Firebase, device vendors, and SMS/email delivery providers). These third parties may have their own terms and policies.

We are not responsible for third-party services, their outages, interruptions, delays, errors, or any acts or omissions by such third parties. Third-party failures may affect your ability to access or use HealthFlow.

11. Disclaimers and No Warranties

HealthFlow is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the service will be uninterrupted, secure, error-free, or that any defects will be corrected.

12. Limitation of Liability

To the maximum extent permitted by law, HealthFlow and its affiliates, officers, employees, agents, and partners shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation damages for lost profits, lost data, personal injury, or business interruption, arising out of or related to your use of (or inability to use) the service.

In no event shall our total liability for all claims related to the service exceed the amount you paid to use the service in the 12 months preceding the event giving rise to the claim, or $100 if you have not paid anything.

13. Indemnification

You agree to defend, indemnify, and hold harmless HealthFlow and its affiliates, officers, employees, agents, and partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the service, (b) your violation of these Terms, or (c) your violation of any law or the rights of a third party.

14. Termination and Data Retention

We may suspend or terminate your access to HealthFlow at any time if we believe you have violated these Terms or engaged in fraudulent or harmful activity.

If you close your account or your account is terminated, we may delete or anonymize your data, subject to applicable legal, regulatory, contractual, and operational requirements (including backups and audit/security logs). For more information, see our Privacy Policy.

15. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. You agree that any dispute not subject to arbitration shall be brought exclusively in the state or federal courts located in San Diego County, California, and you consent to personal jurisdiction in those courts.

16. Arbitration and Class Action Waiver

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of HealthFlow that cannot be resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitration shall take place in San Diego, California, or by video/phone if both parties agree.

YOU AND HEALTHFLOW EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE PROCEEDING.

This waiver does not apply to claims that applicable law exempts from arbitration, such as certain consumer protection claims in California.

17. Changes to These Terms and Notices

We may update these Terms from time to time. If we make material changes, we will provide notice by posting the updated Terms in the app and/or by sending an email or in-app notification. The “Last Updated” date above indicates when the Terms were last revised.

Your continued use of HealthFlow after updated Terms become effective constitutes acceptance of the updated Terms. For material changes affecting your rights or our data practices, we may require you to re-accept the updated Terms before continuing to use the Service.

These Terms constitute the entire agreement between you and HealthFlow regarding your use of the Service.
